KUALA LUMPUR, July 10 — A lorry driver who was charged for riding a motorcycle against the flow of traffic and resulted in a death of a Ducati motorcyclist last month, had admitted that he is a disabled person and is receiving treatment as a mental illness patient.
During the proceedings before the Magistrate Amalina Basirah Md Top today, lawyer Izleen Ismail, from the National Legal Aid Foundation (YBGK), said that her client Mudzyadaha Mohammad, 42, had received a referral letter from a doctor while detained at a hospital in Kajang, Sinar Harian reported.
Izleen also said that her client had even received medication for psychiatric treatment and is also a recipient of assistance from the Social Welfare Department (JKM).
“My client was a train driver before, but now he earns a living by driving a lorry.
“The pressure on his feelings is getting worse since the day he (was) involved in the accident and has to support his wife and three children aged 17, 12 and eight,” she was quoted as saying.
During the incident, Izleen said her client was not in the right mind until the collision.
Izleen then requested the court to allow Mudzyadaha to undergo a psychiatric test in accordance with Section 342 of the Criminal Procedure Code.
Deputy Public Prosecutor Annur Athirah Amran did not object to the matter.
Amalina then ordered the accused to undergo a psychiatric test at Bahagia Hospital Ulu Kinta, Perak.
On Monday, Mudzyadaha pleaded not guilty to the charge of riding a motorcycle against the flow of traffic, which caused the death of the motorcyclist, Ahmad Fadzil Omar Azaddin, 64.
The offence was allegedly committed at Kilometer 22.2 of the Sungai Besi Ulu Kelang Highway (SUKE) at 1.10pm on June 14.
