SHAH ALAM, May 29 — The Shah Alam High Court today ordered Putrajaya and the police to collectively pay RM30,000 in costs to a container equipment operator after finding them liable for the unlawful shooting of the man in 2009.

Judge Datuk Hanipa Farikullah also allowed the plaintiff, Shahril Azlan Ahmad Kamil to be paid for general damages for assault and battery, but the quantum to be paid is still under assessment.

“It is unreasonable for D5 (Constable Mohd Bukhari Mat Noh) to shoot in the name of self-defence as there was no such situation that warrants it.

“The plaintiff has successfully proven assault and battery,” Hanipa said in her judgement.

In his statement of claim, Shahril named the Shah Alam district police chief, the Inspector-General of Police (IGP) and the Malaysian government as defendants.

He is seeking RM18,120 in special damages for the 15-months of rehabilitation he had undergone following the shooting, as well as for repair cost for his vehicle, which was damaged in the incident.

The 30-year-old is also asking for an unspecified amount in general damages and aggravated damages, with an 8 per cent interest rate from the date of the lawsuit.

Hanipa however did not grant Shahril special damages as his claim lacked the necessary documents as proof.

Shahril is now at risk of being paralysed if the bullet, which is still lodged at the left side of his ribs, is removed.

"I thank my family and siblings for being my pillar of support and I hope that PDRM can improve their integrity," Shahril told reporters when met outside the courtroom here.

Shahril also expressed gratitude for the High Court’s decision today, as the money (general and aggravated damages) would now be a guarantee for his health and his children.

"We do not know how it (shooting incident) will affect my health in the future," the father of three said.

Police had fired shots at Shahril when he evaded a police roadblock on April 16, 2009.

The incident transpired when he was on his way home with a friend around 11.30pm, during which he spotted the roadblock and decided to flee after realising that his car's road tax had expired.
